If your Remedial Investigation is not well planned you may end up with insufficient data to justify as cost effective and compliant with the National Contingency Plan (“NCP”) your preferred remedial action alternative, in addition to compromising prospects for recovery of your remedial action costs from other potentially responsible persons (“PRPs”). You should also know that a site cleanup conducted under a Voluntary Cleanup Plan with oversight by the Oregon Department of Environmental Quality or the Washington Department of Ecology is not necessarily equivalent to a cleanup conducted in accordance with the NCP. For both these reasons it’s important to have the guidance of experienced legal and technical advisors before you begin site remediation.
